Minister Malenica signs Second Additional Protocol to the Convention on Cybercrime in Strasbourg

On Wednesday 27 November 2022, the Minister of Justice and Public Administration signed the Second Additional Protocol to the Convention on Cybercrime enhanced co-operation and disclosure of electronic evidence in Strasbourg.

The Convention on Cybercrime was drawn up in Budapest on 23 November 2001. The Croatian Parliament ratified the Convention on 3 July 2002 and it entered into force with regard to Croatia on 1 July 2004.
 
The Additional Protocol to the Convention on Cybercrime concerning the criminalisation of acts of a racist and xenophobic nature committed through computer systems was drawn up in Strasbourg on 28 January 2003. Croatia signed the Additional Protocol on 26 March 2003. It was ratified by the Croatian Parliament on 9 May 2008 and entered into force with regard to Croatia on 1 November 2008. 

The Second Additional Protocol was adopted at the meeting of the Council of Europe's Committee of Ministers, held on 17 November 2021.

The Second Additional Protocol envisages procedures for improving cross-border access to electronic evidence and a high level of safeguards. Its entry into force will contribute to the fight against cybercrime and other forms of crime at the global level by facilitating cooperation between States Parties to the Second Additional Protocol.

In addition, appropriate safeguards are foreseen with regard to international transmission of personal data which comply with the relevant European Union data protection legislation, and, upon entry into force of the Protocol, will facilitate data flow between Member States of the European Union that are Parties to the Second Additional Protocol and third countries that are Parties to the Second Additional Protocol.

Ahead of the signing, Minister Malenica met with European Court of Human Rights President Síofra O’Leary. They discussed the Court's activities and cooperation with Croatia.
