Notification of Victims of Unsupervised Inmate Release

The Service for Victim and Witness Support carries out the tasks of informing the victim or the victim’s family of an inmate’s release from imprisonment pursuant to Article 8(3) of the Execution of Custodial Sentence Act (Narodne novine No. 14/21) and the Ordinance on the Notification of Victims of Unsupervised Inmate Release (Narodne novine No. 81/23). 

Pursuant to Article 43(1)(10) of the Criminal Procedure Act (Narodne novine No. 152/08, 76/09, 80/11, 121/11 - consolidated text, 91/12 - Decision of the Constitutional Court of the Republic of Croatia, 143/12, 56/13, 145/13, 152/14, 70/17, 126/19 and 80/22), as a victim of a criminal offence, you are entitled, at your request, to be notified without undue delay of the termination of police custody or pre-trial detention, the escape of the accused and the release of the convict from prison and the measures taken for your protection. The victim will be notified of the termination of police custody or pre-trial detention and the escape of the accused by the court and the police, if they so requested in the course of the criminal proceedings.

The Ordinance on the Notification of Victims of Unsupervised Inmate Release (Narodne novine No. 81/23) regulates the notification of the victims of criminal offences of misdemeanours, or their family members when the victim is deceased, on the unsupervised release or escape of the person serving a custodial sentence for a criminal offence or misdemeanour which caused harm to the victim, and ensures that victims and their family members are notified in a timely manner of an unsupervised release of the inmate concerned from the correctional institution, whether it is a regular release from prison, a conditional release, an interruption of the custodial sentence or a temporary release from prison.

The victim can, at their request, obtain information about the convict’s release from imprisonment from the Ministry of Justice and Public Administration, Service for Victim and Witness Support.
