First conference of the project “e-Court Register – phase 2”

The first conference of the project “e-Court Register – phase 2” was held at the Matis Absolut Lounge in Zagreb on 25 May 2023. 

The conference was opened by Director General for Civil, Commercial and Administrative Law Mirela Fučkar, who presented some general information about the project and emphasised the contribution of the project.
The project started on 16 August 2022 and is envisaged to take 15 months, i.e. until 16 November 2023.
 
The project is co-financed by the European Union from the European Regional Development Fund, under the Operational Programme “Competitiveness and Cohesion 2014-2020”, and the total project value is EUR 1,456,310.31.

The project will contribute to the modernisation and improvement of judicial proceedings, and the new services will facilitate the access of economic operators to the Court Register and procedures relating to registration in the Court Register, which in turn will facilitate their change management, organisation and association with other operators.
 
Ana Bokulić, Project Manager from the Ministry of Justice and Public Administration, presented the phases of development of the Court Register. The first phase has been completed. The Court Register has been connected to the European e-Justice Portal and channels have been established for the exchange of information with other EU registers (BRIS) concerning branches and cross-border mergers of companies, and an e-service was introduced for registering a company remotely, available for the most common types of companies (limited liability company and simple limited liability company) has been established.
 
The second phase of the project includes the introduction of a new e-service that will improve and simplify the communication of economic operators with courts, especially with regards to the establishment of other forms of companies which cannot be registered digitally through e-Establishment (general partnership, limited partnership, economic interest grouping, joint stock company, more complex limited liability company, Societas Europaea (SE), European economic interest grouping (EEIG), European Cooperative Society (Societas Cooperativa Europaea, abbr. SCE), institution, union of institutions, cooperative, cooperative alliance, credit union and other persons that must be registered by law).
 
The legal framework for electronic communication of participants in Court Register proceedings is governed by the Court Register Act (CRA), the Companies Act (CA) and bylaws, and partly by Directive (EU) 2019/1151 of the European Parliament and of the Council of 20 June 2019 amending Directive (EU) 2017/1132 as regards the use of digital tools and processes in company law.
 
Iva Uljanić Škreblin, Project Team Leader on the part of the Contractor – Primus savjetovanje d.o.o., elaborated on the activity of upgrading the Court Register in order to introduce new e-services. The main element of the project includes an environmental analysis, development of functional and non-functional specifications and data migration, system design and development, software support and establishment of the system infrastructure, system testing and data migration, training and the launch and handover of the system.
 
The outcome of the activity is the establishment of support for business processes, interconnection of participants in Court Register proceedings and technological enhancement of the Court Register system for the purpose of introduction of new e-services.
